Agreement and Acknowledgement

The Disclaimers below ("Disclaimers") constitute an Agreement ("Agreement") between you ("you") and Falcon Shamanic Healing & Magick LLC ("us", "we", or the "Company"), a spiritual services limited liability company in California.

These Disclaimers apply to your use of the Company website (accessible on the Internet at https://www.falconmagick.com/), your oral and written communications with the Company, Company products and your purchase of them, and to spiritual, counseling, healing, magick, divination, and advising services you receive from the Company (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have read and understand this Agreement, and you accept and agree to the terms and conditions of the Disclaimers.

For further details on using our Services, please refer to our Terms of Use Agreement available on the Company website at https://www.falconmagick.com/terms_of_use, and also to our Privacy Policy available online at https://www.falconmagick.com/privacy_policy. By using the Company's Services in person or via the Internet, you agree to be bound by the Company's Terms of Use and Privacy Policy Agreements that are expressly incorporated into this Agreement by this reference.

Medical Practice Disclaimer

Scotch Wichmann ("Scotch"), an employee of the Company, may provide shamanic and/or magick Services to you, which may include spiritual divination, treatments, healing, spellcasting, and counseling that draw upon shamanic, ancestral, and metaphysical traditions and training.

Be advised that Scotch is not a licensed physician or surgeon, and both Shamanism and magick are not regulated by the state of California.

Shamanic healing and magick do not replace the need for conventional psychological and medical treatment. The information on the Company's website, and information and treatments you receive from the Company or its employees, are not intended to diagnose or treat any illness, and you are advised to contact a licensed physician for medical or psychological concerns you may have.

Confidentiality Disclaimer

Scotch is a shamanic practitioner trained by the Foundation for Shamanic Studies and an ordained Reverend with the International Metaphysical Ministry who provides spiritual Services in a professional clergical capacity to communicants whose identities, personal information, and communications (collectively, "Privileged Information") are confidential. The Privileged Information's confidentiality is believed in good faith to be protected by clergyman-communicant privilege under U.S. precedent, state laws, and federal First Amendment religious safeguards. You acknowledge and accept however that like certain other Privileged Information often conveyed in medical, psychiatric, religious, or spiritual settings, the aforementioned protections are not absolute, and may not apply in every case, since laws and legal interpretations can vary by jurisdiction, and therefore you accept that the confidentiality of Privileged Information cannot be guaranteed, especially if subjected to legally binding rulings in jurisdictions that refuse to observe the above good faith protections.

If Privileged Information received provides credible evidence that you or others may be in physical danger, you hereby permit Scotch, at his sole discretion, to report details of such credible threats of potential abuse or violence to the proper authorities.

Internet and Security Disclaimer

This Agreement does not extend to anything that is inherent in the operation of the Internet, and therefore beyond the Company's control, and is not to be applied in any manner contrary to applicable law or governmental regulation. This Agreement only applies to information collected through the Services. This Agreement does not apply to any information we may collect from you in any place other than the Services.

Our website may contain links to other websites. If you choose to visit other websites, we are not responsible for the practices or content of those other websites, and it is your responsibility to review the policies at those websites to confirm that you understand and agree with their policies.

Our Services have reasonable security measures in place designed to prevent accidental loss of your personal information and from unauthorized access, use alteration, or disclosure of the information that we obtain from you. However, we cannot guarantee the security of any information you disclose. By using the Services, you expressly acknowledge and agree that we do not guarantee the security of any data provided to or received by us through the Services and that any personal information, general information, or other data or information received from you to us is provided to us at your own risk, which you expressly assume.

Warranty & Liability

Shamanism is an ancient healing method concerned with resolving spiritual problems that shamans believe are at the root of many psychological and physical illnesses. However, because shamanic work operates at the spiritual level, it is not possible to predict treatment outcomes, which will vary from client to client.

You agree that the Company and its employees make no representation or warranty regarding the Services, express or implied, either in fact or by operation of law, statute, or otherwise, and you disclaim any and all implied or statutory warranties including warranties of merchantability and of fitness for a particular purpose.

You acknowledge and agree that spiritual Services may involve interacting with spirits, energies, and other parapsychological phenomena (collectively, "Phenomena") and that these interactions are entirely at your own risk with the Company and its owners, officers, and employees held harmless for any and all physical and non-physical effects the Phenomena cause or produce anywhere at any time.

You assume the risk of any and all damage or loss incurred as a result of your use of the Services, and agree to hold harmless, to the fullest extent allowed by law, the Company and its owners, officers, and employees from and against all claims, demands, suits, actions, payments, liabilities, judgments and expenses (including attorneys' fees) arising out of or resulting from the acts or omissions of the Company and its owners, officers, or employees in the performance of Services and this Agreement. Liability includes any claims, damages, losses, and expenses arising out of or resulting from performance of Services or this Agreement, or any activity that results in any claim for damage whatsoever including, but not limited to, any corporeal or non-corporeal injury, unwanted Phenomena effects, exposure of Privileged Information, or damage to or destruction of tangible property, including the loss of use resulting therefrom.

Governing Law

You agree that all claims arising out of or relating to our Services and this Agreement will be governed by California law, excluding California's conflict of laws rules, and will be litigated exclusively in the federal or state courts of Los Angeles County, California, USA.

Updates

Changes to these Disclaimers will become effective on the date they are posted on the Company website. We reserve the right to change our Disclaimers at any time and from time to time in our sole and absolute discretion without the duty to notify you. Changes, modifications, additions, or deletions will be effective immediately on their posting to the Company website. You should check these Disclaimers periodically as its terms may change from time to time without prior notice to you. Your continued use of the Services after we post any such modifications will constitute your acknowledgment of the modified Disclaimers and your agreement to abide and be bound by them. We will also revise the "last updated" date found at the beginning of this document when we post changes to it.

Severability

If any part of these Disclaimers is held or made invalid by a court decision, statute, rule, or otherwise, the remainder of this Agreement shall not be affected thereby.
